Welcome to Craft & Counsel! We're Angela and Vaughan, and we're genuinely excited you're here. These terms might look formal (because legally, they have to be), but we want you to know we're real people who care about doing right by our restaurant community.

About These Terms
By using our website, services, or engaging with us in any way, you're agreeing to these terms. We've tried to keep the legalese to a minimum, but some things need to be spelled out clearly. If something doesn't make sense, just reach out – we're always happy to chat.

Our Services
Craft & Counsel provides restaurant and hospitality consulting services including:

  • Concept development and strategic planning

  • Training programs, HR support, and operational manuals

  • Restaurant rescue and rebranding initiatives

  • Marketing strategy and social media management

  • Menu development and beverage program creation

  • Operational systems implementation

  • Site selection and lease negotiation assistance

  • Financing guidance and support

SMS Text Messaging Program

Opt-In Agreement
When you provide your mobile phone number and consent to receive text messages from Craft & Counsel, you're agreeing to the following:

What You're Signing Up For: You'll receive text messages with restaurant industry insights, tips, updates about our services, and occasionally, special offers. Think of it as getting advice from friends who've been in the trenches.

Frequency: We respect your time and your phone. Message frequency varies but typically ranges from 1-4 messages per month. We might send more during special promotions or if there's breaking industry news we think you need to know about.

Message and Data Rates: Standard message and data rates may apply. Check with your wireless carrier if you're unsure about your plan.

Supported Carriers: Our SMS service works with most major U.S. carriers including Verizon, AT&T, T-Mobile, Sprint, and many others. If you're having delivery issues, let us know.

Your Rights and Choices

Opting Out: You can stop receiving our text messages anytime by:

  • Replying "STOP" to any text message from us

  • Texting "STOP" to our SMS number

  • Emailing us at hello@craftandcounsel.com

  • Calling us at (828) 222-3723

After you opt out, you'll receive one final confirmation message, then no more texts from us (unless you opt in again).

Getting Help: If you need assistance with our SMS program, text "HELP" to our SMS number or contact us directly. We're here to help, not to make your life complicated.

Privacy: We take your privacy seriously. Your mobile number and SMS preferences are protected according to our Privacy Policy. We don't sell your information – that's not how we roll.

Consent and Age Requirements

By opting into our SMS program, you confirm that:

  • You're at least 18 years old (or have parental consent)

  • You're the account holder or have authority to consent for the mobile number provided

  • You understand that consent isn't required to purchase our services

Website Use and Intellectual Property

Our website contains content we've created, including our story, methodologies, and insights gained from 30+ years in the hospitality industry. While we love sharing knowledge, please respect our intellectual property.

What You Can Do:

  • Use our website for legitimate business purposes

  • Share our content with proper attribution

  • Learn from our experiences and apply insights to your own operations

What We Ask You Not to Do:

  • Copy our content without permission

  • Use our site in ways that could harm us or others

  • Attempt to access restricted areas of our site

Service Terms and Limitations

Every restaurant situation is unique – trust us, we've seen it all. While we bring decades of experience and proven methodologies, we can't guarantee specific results. Success depends on many factors, including your commitment to implementing our recommendations.

Payment and Cancellation
Payment terms will be outlined in individual service agreements. We believe in being upfront about costs – no surprises, no hidden fees.

Limitation of Liability
We're passionate about helping restaurants succeed, but we need to be clear about legal limitations. Our liability is limited to the amount you've paid for our services. We're not responsible for indirect or consequential damages.

This might sound harsh, but it's standard business practice. What's not standard is how much we genuinely care about your success.

Privacy and Data Protection

We collect and use information as described in our Privacy Policy. Here's the short version: we only collect what we need, we protect what we collect, and we never sell your information.

For SMS specifically:

  • We store your mobile number securely

  • We track delivery and engagement for service improvement

  • We comply with TCPA and other applicable regulations

  • You can request deletion of your information anytime

Changes to These Terms

Sometimes we need to update these terms. When we do, we'll:

  • Post the updated version on our website

  • Send notice to your email or phone if the changes significantly affect our SMS program

  • Give you a reasonable chance to review changes before they take effect

Geographic Scope

Our services primarily focus on the U.S. restaurant market, though we've worked internationally. SMS services are currently available in the United States only.

Client Portal & Digital Marketing Services

Craft & Counsel offers a client-facing portal and digital marketing services in addition to our hospitality consulting work. The following terms apply specifically to these services.

Client Portal Access
When you are invited to access the Craft & Counsel client portal, you are provided with a private, password-protected account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at hello@craftandcounsel.com if you suspect any unauthorized access.

Data Collection & Storage
In connection with our portal and digital marketing services, we collect and store business information you provide, including company details, contact information, marketing preferences, and materials you upload such as logos, photography, and brand assets. This information is stored securely and used solely to deliver services to you. We do not sell or share your business data with third parties outside of our service delivery partners.

AI-Assisted Services
Craft & Counsel uses artificial intelligence tools, including Claude by Anthropic, to assist in generating client briefs, content strategy recommendations, and marketing insights. All AI-generated materials are reviewed by our team before being shared with you. These outputs are advisory in nature and do not constitute a guarantee of results. You retain ownership of any final work product delivered to you under your service agreement.

Audio Recording & Transcription
With your consent, discovery calls and strategy sessions may be recorded and transcribed to build your client profile and inform our work on your behalf. Recordings are stored securely, used solely for service delivery, and are not shared outside of your Craft & Counsel team. You may request deletion of any recording at any time by contacting hello@craftandcounsel.com.

Digital Marketing Services
Craft & Counsel provides digital marketing services including but not limited to website development, SEO, social media management, paid advertising, email marketing, and competitive analysis. Results from digital marketing services vary based on industry, market conditions, budget, and your participation in the process. We commit to transparent reporting and honest communication about performance at all times.

Third-Party Platforms
Our services involve integration with third-party platforms including but not limited to Go High Level, Supabase, Deepgram, Google, and Meta. Use of these platforms is subject to their respective terms of service. We are not responsible for changes, outages, or policy updates from third-party providers.

Service Agreements
Specific deliverables, timelines, and payment terms for digital marketing and portal services are governed by the individual service agreement or proposal signed between Craft & Counsel and the client. In the event of a conflict between these general Terms & Conditions and a signed service agreement, the signed agreement takes precedence.

Dispute Resolution
We'd rather solve problems over coffee than in a courtroom. If something goes wrong, let's talk first. If we can't work it out directly, any disputes will be resolved through binding arbitration in North Carolina.

Severability

If any part of these terms is found to be unenforceable, the rest still applies. We wrote these terms to be reasonable and fair – if a court disagrees with one part, we hope they'll let the rest stand.
